Over the years, we have handled some employment cases that were significant enough to result in published decisions by various courts.  Here are some of the cases we have won.  You can read the synopsis or click on the case citation to read the full text of the court's opinion


.Loffa v. Intel Corp.

Frank Loffa was fired from his job as a maintenance man at Intel when he was accused of threatening a fellow employee.  We sued for breach of employment contract, using Intel's policies on termination as part of the contract.  The jury's verdict in Frank's favor was upheld on appeal.

O'Day v. McDonnell Douglas Helicopter Co. (federal)

Dennis O'Day claimed he was chosen for layoff because he had complained about age discrimination.  When the company learned he had copied some documents from his supervisor's desk that he believed would help prove his case, the company convinced the court to dismiss the lawsuit.  The Court of Appeals reversed the dismissal.

After Dennis O'Day's case was returned to the District Court, we asked the Arizona Supreme Court to answer an important question about the kinds of damages Dennis could recover.  The court laid down a rule for damages in wrongful discharge cases under state law that the federal court of appeals had not decided.

Olsen v. Marriott Int'l.

Ralph Olsen applied for a job as a massage therapist at the Spa at Camelback Inn.  He was rejected because the Spa wanted to hire a woman.  He sued for sex discrimination, and the U.S. District Court ruled that the Spa could not discriminate on the basis of sex in hiring massage therapists.  

Shaver v. Operating Engineers Local 428 Pension Trust Fund

Bill Shaver and other members of the union were concerned about the amount of money the pension trustees were spending on small miscellaneous expenses.  The trustees refused to give them an accounting.  They sued to get the information, but the case was dismissed.  The Court of Appeals for the Ninth Circuit reversed part of the decision and sent the case back to the trial court.
